We venture to suggest that Counsel's fees might be allowed
on the same scale as those paid to Junior Counsel for the
Crown.
With regard to our own costs we are aware that any
allowance made to us in respect of them would be in the
nature of a concession by the Treasury. We would point out,
however, that the case was one of considerable importance
involving difficult questions of law, and necessitated a
very large amount of work and care in its preparation. We
had no option but to take the immediate conduct of the case.
owing to its urgency, as the papers were not received by
us until nearly the middle of May 1913, and execution of
the sentence had only been respited until the 18th June
1913.
We trust therefore that you will consider this is a
case which you can recommend as being one where suitable
provision should be made for our costs, and to enable us to
pay such fees to Counsel as may be sanctioned by the
Treasury.
